I am not arguing that a 15, 16 or an 8 year old knows and understands the permanence of murder. My contention is that the USA Constitution guarantees due process in criminal trials. Minors cannot competently participate at the same level as an adult in due process in a court of law therefore they should not be tried as adults.

Yahoo is talking about as well. It seems with this type of thing - every story tries to add their own spin to it.

I'm sure this will NOT be the last we hear of this case.

Its heart breaking no matter where it goes.

CNN headline news has the release of this tape of the 8-year-old boy "confessing" to the murders.

So not only are there issues relating to the age of this child and his ability to understand, IF they do hold a trial, how in the world would he ever receive a fair trial?

Further, the article states this: A judge issued a gag order in the case, preventing police, prosecutors or defense attorneys from commenting on it. Of course this is just my own personal opinion, but who needs to hear comments from anyone else when they are releasing this tape?

Okay, I already have issues concerning our judicial system ... having served on the jury for two murder trials.

Stuff like this just makes me so angry!

How in the world is the confession public record BEFORE the trial??
